How to Get a False EPO Dismissed
- 1). Obtain a motion-to-dismiss form from the court clerk. Some courts may make this form available online. If not, go to the court to pick it up or call the court clerk's office and ask them to mail it to you.
- 2). Read the EPO carefully to understand the allegations against you, then complete the motion-to-dismiss form and include any evidence you may have to support your position by attaching it to the form.
- 3). File the completed form, along with your attachments, by taking it to the courthouse and submitting it to the clerk of the court listed on the EPO.
- 4). Mail a copy to the person initiating the EPO or to that person's attorney and to any other party to the EPO.
- 5). Attend any hearing the court instructs you to attend, or that may be listed on the EPO. Once the judge has heard both sides, the EPO will either be upheld or dismissed.
