How to Change Date of Birth
- 1). Obtain a copy of the incorrect birth certificate. Contact the hospital where the person was born to discuss the error. Request written documentation and records from the hospital to confirm the mistake. Obtain certification of the error from the hospital in the form of written affidavits of those persons with knowledge of the error.
- 2). Check with the court in the jurisdiction to determine exactly what documentation is required to be filed with the court. Generally, the court requires the filing of a petition with a supporting motion and documentation to request the court make the change of birth legal. To find out what the court requires, check with the Court Clerk in the jurisdiction. Generally, the court will require affidavits from those persons with knowledge of the error.
- 3). Follow all court instructions. An appearance in court to testify about the matter may be required. Contact the court to determine if self-representation is permitted, or if an attorney should be present when making an appearance.
- 4). Once the court has approved the petition, it is necessary to change all other identifying documents, which contain the error. Contact your state's Department of Health and/or Vital Statistics to file the change and to request a new birth certificate that contains the corrected birth date. This birth certificate will then be utilized to change all other essential documents.
- 5). Contact the U.S. Social Security Administration to make sure the correct information is filed. The Social Security Administration will request the new birth certificate. If there is a passport with the incorrect information, contact the U.S. State Department in the jurisdiction, as well, to correct the birth date as well. Also, it is advisable to contact any other relevant entity, such as your state's Department of Motor Vehicles, financial institutions and employer to ensure that the correct birth date is filed with each entity.
