Drunk driving laws in Virginia impose jail time and fines and suspend the license of those convicted of the offense. The state also requires some drivers to install an ignition interlocking device when the license is reinstated. Drivers are guilty of drunk driving when their blood alcohol level reaches .08 or more in Virginia, which is the standard in all 50 states. For drivers under age 21 the legal limit is .02 and commercial drivers have a limit of .04 in Virginia. - Drivers convicted of a first offense for drunk driving in Virginia face a one-year suspension of the driver's license. Second offenses in the state cause a suspension of three years and those who are convicted of a third offense face an indefinite license suspension. A driver with an indefinite driver's license suspension can petition the state for reinstatement after five years. The length of license suspension in Virginia is mandatory and applies to all convicted drivers.
