DWI Vs. DUI in Washington
- Washington state applies penalties to any adult who tests positive for a blood alcohol level of .08 or higher, and .02 for those under the age of 21. The term DUI applies to any person operating a motor vehicle who has been "affected" by alcohol, or legal or illegal drugs.
- Washington state's implied consent law requires suspected individuals to submit to a blood or breath test. Those who refuse will automatically lose their driving privileges for at least one year. To contest a charge of DUI, a driver may request a hearing within 20 days of the arrest, for a filing fee of $200.
- Though any amount of impairment above the legal limits is considered a crime, the punishments do vary according to how high your blood alcohol level is as well prior offenses. Your license can be suspended from 90 days to four years, and other penalties could include jail time. Even a first offense for DUI will remain on a driver's record for 15 years, and will carry of fine of $5000 plus various other fees.
