How to Legally Erase Your Credit Files

    • 1). Find out which credit files should be legally erased. Go to AnnualCreditReport.com and order a free credit report. You will receive your report from the three major credit reporting agencies: TransUnion, Equifax and Experian.

    • 2). Look for items that need to be erased from your credit files. Keep in mind that to legally erase your credit files the items must be placed on your report in error. You cannot erase files that are supposed to be there no matter how unattractive the file may appear. Search for items that do not belong to you or were reported incorrectly. Look for things like unsatisfied liens or judgments, delinquent payments, incorrect credit limits, charge-offs or any other incorrect, derogatory information.

    • 3). Backup your findings with written documentation. Credit reporting agencies won't legally remove the credit files without documented proof. Gather documentation such as release-of-lien letters, canceled checks, money order receipts, loan satisfaction letters or any other documentation to prove the credit items should be erased.

    • 4). File a dispute with the credit reporting agencies. You can either send a letter, or file an online dispute by visiting each of the credit bureau websites and using their online dispute form. If you choose the online option, scan your backup documentation to convert it into an electronic format such as PDF or DOC so that you can attach it to your dispute. If you choose to write a letter, include specific information such as the creditor name, account number, dates, amounts and a detailed explanation as to why the credit files should legally be erased. Don't forget to include copies (not the originals) of your backup documentation.

    • 5). Stay on top of your request to have the credit files erased. Credit reporting agencies have 30 days to investigate the dispute and notify you in writing of the outcome. If 30 days come and go and you haven't received written notification, you must follow up in writing for a resolution. Follow up every 30 days until the credit files are legally erased.
