- 1). Prepare all necessary forms. There are five: Petition for Dissolution of Marriage with Dependent Children; the Family Law Financial Affidavit; Uniform Child Custody Jurisdiction and Enforcement Affidavit; Summons; and Child Support Guidelines Worksheet. Indicate in the petition that you are seeking custody of your children. All forms you will need are found on the Florida State Courts Self Help website.
- 2). Sign all forms and make several copies.
- 3). File the forms with the Polk County Clerk of the Circuit Court at 255 N. Broadway Ave.; Bartow, FL 33830. Pay the required filing fee. Contact the court directly for the current fee amount, since it can change at any time. You can reach the court at 863-534-4540.
- 4). Abide by all orders of the court while the dissolution proceeding is pending. The court may order you to attend counseling, mediation or order a home study evaluation to help determine custody.
