How to File Small Claims Cases in New Hampshire

39
    • 1). Send a formal letter to the person that allegedly owes you money requesting that they pay you the amount owed. This may be all that is required to force payment. If this doesn't resolve the issue, proceed with the actual filing of the small claims case.

    • 2). Go to a New Hampshire district court to file your claim. To file small claims you can go to the district court for where you live, where the defendant lives or where the
wrongdoing took place. In most locations the district court will be open from 8:00 a.m. to 4:30 p.m., Monday through Friday.

    • 3). Locate the district or municipal court clerk within the district court. There will be signs within the district court to guide you right to the location to file small claims.

    • 4). Request from the court clerk the complaint form that is required to begin the small claims case process in New Hampshire.

    • 5). Fill out the complaint form with the required information. This will include the defendant's name and address, as well as the amount in dispute. Remember that the amount can be up to $7,500.00 that they owe you, although you can only be paid up to $5,000.00 through small claims. This is often preferable, due to the fact that if a lawyer is used for the same dispute, the plaintiff will often pay out more than $2,500.00 in lawyer fees.

    • 6). Give the completed complaint form as well as the application fee to the court clerk. The application fee will be about $60.00. Although, if the claim is against more than one person the amount may be more. Ask the clerk about this before you file, as individual cases do vary.
