How to Switch Guardianship
- 1). Contact the family court for the area in which the child currently resides. Ask for the forms required to transfer guardianship from one person to another. They'll include a petition for guardianship and a consent-of-guardianship transfer. The former makes the case for guardianship being granted to one person; the second gives the consent of the current parent or guardian to give up guardianship in favor of someone else.
- 2). Fill out the forms. You'll need the parent or guardian's current information, the child's personal information (including name, address and place of birth), the new guardian's information and the reason(s) guardianship should be transferred. You'll need to clearly explain why a transfer of guardianship is best for the child.
- 3). Turn the forms into the family court and include the necessary filing fee. Once the documents have been turned in, they'll be reviewed; a date will then be set to hear the case for transfer of guardianship. The court will interview all participants, make home visits with the current guardians, and, if the child is old enough (14 in some districts, though the laws vary), ask her for an opinion as to which guardian she prefers. A court date will then be set for the official review and either a granting or denying of the guardianship transfer.
