Ferry Lawsuit Raises Liability Questions
Another lawsuit has been filed in the aftermath of a boat accident in NYC.
Lawyers for a Wall Street broker, who remains in a hospital, submitted a $45 million claim against the drivers of the ferry, the Seastreak Wall Street. The ship had 326 passengers onboard when it drove into a concrete slip while attempting to dock at a pier in NYC.
Many other lawsuits have also been submitted in federal court against Seastreak on behalf of people injured in the accident.
The ferry company, however, just sought protection under international waters law that would limit its liability in the collision to the total of the wrecked ferry, which is estimated at $7.6 million. The company has also sought an order that would consolidate all claims against the company to court.
Advocates for those hurt seek to have the case decided by New York law, arguing that the boat was not seaworthy at the time of the accident and the company knew it. They also want any maximum of burden, if accepted by the court, set at the value of all of the vessels under Seastreak's command.
Attention will likely focus on modifications made to the vessel last summer to increase fuel economy and lower the cost of operation, and whether those changes led to the accident.
