How to Set a Divorce Court Date
- 1). Negotiate a settlement of the primary issues associated with the divorce with your spouse. These include resolving issues related to allocation of assets and debts. Issues of child custody, support and parenting time or visitation need to be resolved as well.
- 2). Draft a settlement agreement that puts into writing the agreements you reached with your spouse in regard to the major issues associated with the divorce.
- 3). Complete the divorce parenting classes mandated by the court. In most jurisdictions in the United States today, parents who are divorcing must complete parenting classes. You will obtain a certificate upon completion of the course. The petition is filed with the clerk of the court.
- 4). Contact the administrative assistant to the judge presiding over your divorce case. Advise her that all of the requirements of a divorce settlement are met. Request a court date. On the other hand, if you are unable to settle the case, advise the judge's assistant that you are unable to resolve the case. Request a trial date from the administrative assistant.
