How to Reverse a Separate Maintenance Agreement
- 1). Consult with your spouse and discuss the parameters for reversing or terminating the separate maintenance agreement. Because a separate maintenance agreement is filed with the court as part of a separate maintenance or legal separation case, terminating the agreement typically requires the agreement of both spouses.
- 2). Draft a contract to be signed by both you and your spouse terminating the separate maintenance agreement. The document is not complicated.
- 3). Insert the date the original separate maintenance agreement was entered in the document terminating that initial contract.
- 4). Include a brief statement saying why you desire to reverse the separate maintenance agreement.
- 5). Place the case number for the separate maintenance or legal separation proceeding as well as the caption at the top of the termination document.
- 6). Execute the termination document. Both you and your spouse sign the reversal document. In some states you may need to sign the document in front of a notary public.
- 7). File the reversal or termination document with the clerk of the court.
