    • The EB-3 visa is an employment-based immigration visa intended for people who wish to become permanent residents in the United States because of their job.

    Professionals

    • Those applying for the EB-3 visa as a professional must have a baccalaureate degree or a foreign degree that is equivalent. Professionals must have the proper education in order to qualify as a professional on the EB-3 visa. They cannot substitute work experience for education in this field. The educational background is a requirement. Professionals include doctors, lawyers, teachers and professors. Other work backgrounds qualify as professions. Check with the United States embassy/consulate near your current residents for more information on whether you qualify as a professional.

    Skilled Workers

    • Skilled workers also qualify for the EB-3 visa. If you are an EB-3 visa applicant to obtain a green card you may qualify as a skilled worker applicant. Skilled workers are people that have worked at least two years within a specific profession and with to work utilizing that profession in the United States. There are no educational requirements for skilled worker EB-3 visa holders.

    Unskilled Labor

    • Others can work in the United States as unskilled labor. They have less than 2 years of training or experience, but they are willing to work in a field where the labor market is not impacted in the United States for a task that they are able to perform. If the workers are willing to work exclusively within a labor market that is not impacted in the United States, the worker may also qualify for the EB-3 immigrant green card visa.

    EB-3 Visa Process

    • The employer must request the EB-3 visa on your behalf. He must complete paperwork and file it with the United States Department of Labor. Once he files with the United States Department of Labor, you will be granted a work visa and you will be able to work in the United States. After your employer files the appropriate paperwork, you must file an Immigrant Petition Form I-140 with the United States Citizenship and Immigration Services (USCIS). After this has been processed, the visa holder must apply for one file for a change of status with the USCIS. You will then be a EB-3 visa holder.
