How to Request a Different Indigent Attorney
- 1). Determine the reasons for which you wish to dismiss your attorney. The court will not remove an attorney unless there are compelling reasons; for example, a conflict of interest or misconduct. Failure to zealously defend your case is also grounds for removal of an attorney.
- 2). Request a new attorney in writing. Write a letter to the court explaining the reasons that you would like a new attorney. Present the letter to your current attorney, and ask him to submit the letter to the court.
- 3). Attend the court hearing. The judge will need to hold a hearing regarding your request. Be prepared to speak and to explain your reasons.
- 4). Wait for the disposition of the court. The judge will give a written decision. If the judge agrees with your reasoning, he will appoint a new attorney.
