How to File an Appeal in Small Claims Court
- 1). Acquire a copy of the case’s transcript. Allow a lawyer to look over the transcript. The lawyer will be able to advise you on whether you should appeal the judge’s decision or not.
- 2). Sit in on a few small claims appeals to familiarize yourself with the process. Ask the court clerk when the small claims appeals are scheduled. This will get your prepared for your state's specific appeal process.
- 3). Fill a notice to appeal with the district court within the correct time frame. You may be required to deliver a copy of the notice to appeal with the judge who heard the case as well as all parties that were involved. The clerk at the district court in your county will be able to provide you with more information.
- 4). Pay the filing fee. You will be required to pay a filing fee, which is typically around $200 in 2010, but varies from state to state. Some states also require a deposit made to the Clerk of Appellate Division. Contact your county court house for more information.
- 5). Gather all your required information and evidence. If your appeal is granted you must prepare your case once again.
