How to File Taxes Separate From a Spouse

3
    • 1). Locate the federal income tax form you need to file, which is either the 1040A or the 1040 on the Internal Revenue Service website. Those who file “married filing separately” cannot file a form 1040EZ as it is limited to only people filing “single” or “married filing jointly.” Determine which form is right for you based on the deductions you are going to take. Form 1040 can be used by anyone and includes any deduction. Form 1040A is for taxpayers who do not have capital gains, rental income or file a Schedule C for self-employment taxes.

    • 2). Enter only your information on your tax form, either on paper or using the IRS’ E-File option using the link in Resources. Check the box for “married filing separately.” You will need to enter your spouse’s name in the box next to your filing status and the spouse's Social Security number in the personal information section.

    • 3). Continue to fill out the remainder of your federal income tax return by using the instructions provided with the form. Enter only your income and tax information. You cannot claim any of your spouse’s income or tax information on your tax return when filing separately.

    • 4). Mail or electronically submit your return to the IRS. If you are mailing a paper return, you will find an address in the instructions based on your home state. Your spouse will need to file income taxes the same way.
