How to File for Child Custody in Connecticut
- 1). Contact an attorney who can answer any questions you have over child custody. The lawyer should have experience in family law. You will find out how much it costs to file and the correct way to file for custody. You can file for custody on your own or hire the attorney to file for you.
- 2). Contact your local family court office. The clerk of court will tell you what form you will need to fill out. Connecticut has adopted the Uniform Child Custody Jurisdiction and Enforcement Act, which states that you can file for custody only in the state where the child has lived in for the last six months. If you live out of state, you cannot file to take the child to another state unless the child is in danger.
- 3). Fill out the required paperwork for your circumstances. If you and the other parent agree to the change in custody, there will be a different form to fill out than if you both disagree. You will also need to fill out a form on visitation and income. The clerk of court will give you the correct forms that you need for Connecticut.
- 4). File the papers with the court and obtain a court date. You may need to pay a filing fee in order to file the papers. Most courts will not take checks so bring cash. You can call the clerk of court for family courts ahead of time to find out what the fees are and what type of payment they accept.
- 5). Deliver the copy of the papers to the other parent. The papers will notify the parent of your intentions and will provide her with a court date.
