How to Release a Subpoena in Florida
- 1). Call the attorney for the opposing party and asked to be released from the subpoena. If you do no have the information or documents requested by the subpoena, inform the opposing party's attorney.
- 2). Call the court and provide a valid reason to be released from the subpoena. Florida's rules of civil procedure only list one specific reason for an immediate release from a subpoena. Rule 1.410 section two states a person may be required to attend an examination only in the county where the person lives or is employed.
- 3). Check with the court or opposing attorney to see if your testimony or evidence is still needed. If your presence is no longer necessary, then Florida courts allow witnesses to be released from the obligations of a subpoena.
