How to Apply for a USA Non Immigration Work Permit
- 1). Have the alien collect the information and documents needed to complete an application for employment authorization with all required documentation. If proof of economic necessity is required, have the alien put together a list of assets, income and expenses.
- 2). File form I-765 with the United States Citizenship and Immigration Service to apply. Request a form by mail or call 1-800-870-3676. Mail the form to USCIS, or submit the form at the Regional Service Center near the worker's residence. Employers with a worker applying for permanent residence may file the employment authorization application concurrently with an Application to Request Permanent Residence or Adjust Status, Form I-485. Electronic filing is available for most applications on the USCIS Internet site. Receipt confirmation is immediate for electronic applications.
Pay fee after verifying the fee is correct. USCIS changes the fees on occasion. Verify the fee with USCIS: visit www.uscis.gov and select Immigration Forms, review the fee schedule sent in an application packet, or call 1-800-375-5283. For a payment, send a check or money order in U.S. currency drawn on a bank or financial institution in the United States. For an electronic filing, fees may be paid by credit card or a draw from savings accounts. A fee is not required for certain aliens. - 3). Check the status of the application. USCIS might deny an incomplete application or might need your assistance before approval. You have the responsibility of ensuring that all required forms, information and documents are submitted and received on time.
- 4). If requested by the USCIS, provide more information or complete an interview to finish the application. The government representative may require additional proof before giving authorization.
- 5). If USCIS does not decide within 90 days, file for an interim work authorization. Apply in person at a local district office. The required wait period is 30 days for an application based on asylum.
- 6). Accept an EAD. Typically, USCIS sends the document by mail. You might be required to pick up the document at a local USCIS office.
