The Statute of Limitations on Warrants in New Jersey
- There is no statute of limitations on a warrant. A statute of limitations prohibits the filing of a civil claim or criminal action after a certain amount of time has elapsed. Because executing a warrant is not a cause of action, a statute of limitations does not apply.
- In New Jersey, a judge, or a municipal or deputy court administrator authorized by the judge, can sign an arrest warrant. The warrant must include the name of the defendant or a clear description of the defendant. Any law enforcement officer can arrest the defendant and bring the defendant before the issuing court.
- Even if a New Jersey warrant is not executed immediately, it will not expire. A law enforcement officer can execute the warrant at any time.
